In this regard, he further explained that it was his intention to lead in this race, however, after jumping only fairly and observing 3 horses competing for the lead, as in his last start, he was equally satisfied to obtain cover behind runners in a handy position. He further explained that after shifting in behind runners, his horse commenced to race fiercely, hang in and race on to heels. He stated that he was aware that there were 2 other runners on his inside, however, whilst attempting to correct PACIFIC POWER, the horse resented the correction and shifted in anyway. Thereafter, it was his view that despite PACIFIC POWER acquiring a good position behind the speed and settling somewhat in the running, the gelding again became unbalanced going through the 700M. In the straight, PACIFIC POWER commenced to hang in and shifted in away from the whip, which Jockey O Chavez described PACIFIC POWER’s performance as disappointing. His explanation was noted.

In assessing the penalty, the Stewards took into consideration App S Bahauddin’s mitigating factors, previous riding record and his submissions on penalty. Jockey O Chavez appeared before the Panel and was questioned regarding his riding of PACIFIC HERO. In this regard, he explained that his horse was an aggressive horse, which by nature, shows significant early pace and races to the lead. In this race, his PACIFIC HERO had shown early speed, however after being further engaged by YES MAN, took hold of the bit, resulting in it being unable to be restrained and entering an unintentional speed battle with YES MAN. His explanation was noted.

Jockey B Pinheiro appeared before the Panel and was questioned regarding his riding of YES MAN. In this regard, he explained that he was of the view that with the pattern of racing today, his best opportunity of winning would be to lead. However, whilst attempting to do so, PACIFIC HERO had the same idea which resulted in YES MAN and PACIFIC HERO being positioned alongside each other and dueling for the lead.

When questioned regarding whether there was an opportunity for Jockey B Pinheiro to ease the pressure, he explained that he had attempted to do so, however, he felt his mount immediately resented this action. Therefore, he elected to allow his mount to stride as this was a 1020M race. By the top of the straight, he felt he was travelling better than PACIFIC HERO and attempted to use any advantage he gained to skip away from the field. However in the concluding stages, the early exertions of YES MAN tolled, and he was passed by another runner.  His explanation was noted.

The Panel of Stewards, on Monday, 21 July 2025 at the Selangor Turf Club, concluded an inquiry into the dislodgement of Jockey L De Souza from PACIFIC POWER.

The Panel of Stewards reviewed the films of the incident with Jockey L De Souza and considered the evidence tendered.

At the Inquiry, Jockey L De Souza was charged with a contravention of MRA Rule 44(10) which reads:

“Any Jockey who fails to ride his horse to the satisfaction of the Stewards may be warned, fined and/or suspended.”

The particulars of the charge being that he was dislodged from PACIFIC POWER prior to him exhausting the available remedies to prevent such an incident. Jockey L De Souza pleaded not guilty to the charge, however, was found guilty as charged.

In assessing the penalty, the Stewards took into consideration all the evidence in this matter which included Jockey L De Souza’s mitigating factors, previous riding record and his submissions on penalty. He was suspended from riding in races for a period of eighteen (18) months with effect from 22 July 2025 and to expire on 21 January 2027, both dates inclusive. The Stewards conducted an inquiry on Monday, 21 July 2025 at the Selangor Turf Club, into the above matter. Evidence was taken from App Z Faizol, from whom the sample was taken, in the presence of his Employing Trainer, SY Lim.

At the 450M, GOOD STAR which was angled out for a clear run rolled in onto the heels of ERUPTION upon straightening for home. Thereafter, at the 350M, GOOD STAR was again angled out for a clear run, however, again laid in under pressure resulting in this gelding being positioned on the heels of ERUPTION. Simultaneously, at the 350M, LUCKY MAGIC which was hanging in, in the straight, shifted in to race in close proximity with ERUPTION. Subsequently, at the 300M, GOOD STAR had to ease and shifted out of the heels of the tiring ERUPTION and LUCKY MAGIC in order to obtain a clear run.

A race review was called into this incident, which was followed by an objection being lodged by Trainer T Mahadi, the Trainer of the second placed horse, GOOD STAR (S Uzair) against the winner, LUCKY MAGIC (R Shafiq) on the grounds of interference at the 300M.

After considering the evidence in this matter, the Board overruled the objection as it was satisfied that with or without the above incident, GOOD STAR would not have finished ahead of LUCKY MAGIC.

At this decision, the distance between the horses at the finish (neck), the distance at which the alleged interference occurred, the movements of GOOD STAR and that, it could not be clearly established where GOOD STAR had secured the racing between LUCKY MAGIC and ERUPTION and that the prejudice, if any, caused to GOOD STAR by LUCKY MAGIC changed the result of the race.
